AIOS for care providers

Using AI in a care business: what's expected

If your team already uses AI tools, or wants to, the guidance now spells out the basics.

The basics

  • An AI policy your organisation has adopted (DHSC).
  • No personal data in free tools (DHSC).
  • A person reviewing what AI produces (DHSC), and human oversight (CQC).
  • A DPIA where personal data is involved (CQC).

CQC says "the absence or presence of AI does not predict a specific rating." Using AI won't earn a rating, and neither will avoiding it.

How AIOS uses this

On our five-stage ladder, a process only scores 4 (Agent-assisted) or 5 (Agentic) if those basics are in place. For a lot of care work, stage 4, with a person approving every output, is the right place to stop. The Payback Check tells you what's safe and what's missing for one real process.

FAQ

Will using AI affect our CQC rating?

CQC says "the absence or presence of AI does not predict a specific rating." Using AI will not earn a rating, and neither will avoiding it.

Can staff use free AI tools with care records?

DHSC guidance says that if you are using a free or online tool, you should not use personally identifiable information, because you would be providing confidential information to a third party.

Do we need a DPIA?

CQC lists a Data Protection Impact Assessment among its principles for using AI: it assesses and documents risks to privacy and people’s rights, to enable lawful use of AI.

Is AIOS legal advice?

No. AIOS helps you get set up and use AI safely. It is not legal advice, and we cannot guarantee a compliance or inspection outcome.
